All bonds in New York State must be sworn to before a Judge in Court.  This information is provided to the Court by means of a Justifying Affidavit.

The law requires that someone sign on behalf of the defendant for the bond.  The family member or friend that signs is called the indemnitor/obligor.

The indemnitor needs the following to sign:

1. State or Federal I.D. (Drivers License, etc.) to prove identity.
2. Proof of address like a phone bill, etc.
3. Pay-stubs to prove income.
4. Other proof of income if self-employed (Tax returns, Form 1040)

The Court requieres that collateral be placed on each bail to guarantee that the defendant will appear in court.  The collateral is returned to you once the bond is no longer needed. (You must provide a Certificate of Disposition or Exoneration)

Acceptable forms of collateral are:

1. Money, that can be paid in cash, credit cards, money orders, etc.
2. Property such as a house, land, condo.
3. CD, Annuities or other bank accounts.
4. Any reasonable item of verifiable value. Give us a call and ask!
